IMPORTANT NOTICE: Effective July 1, 2018

REVISED POA Disclosure Packet Notice and NEW Condo Resale Certificate Notice

Effective July 1, 2018, associations subject to the Property Owners’ Association Act (“POA Act”) will be required to furnish the revised POA Act Disclosure Packet Notice as part of all disclosure packets. In addition, condominium unit owners’ associations will now be required to furnish the new Condominium Unit Owners’ Association Resale Certificate Notice as part of any condominium resale certificate.

The Common Interest Community Board adopted these forms as the result of HB 923 passing during the 2018 General Assembly Session. This legislation amended § 54.1-2350 of the Code of Virginia, § 55-509.5 of the POA Act, and § 55-79.97 of the Condominium Act.

Carefully review the forms and be prepared to begin using them for any POA disclosure packets or condominium resale certificates prepared beginning July 1, 2018. Please be advised that failure to provide the required notice as part of a disclosure packet or resale certificate may be a violation of the POA Act or the Condominium Act.
