Pursuant to Executive Order Number Twenty-five (1998), the Department of Environmental Quality will review its Guidelines for the Preparation of Environmental Impact Assessments for Oil or Gas Well Drilling Operations in Tidewater Virginia (9 VAC 15-20-10 et seq.). The purpose of the review is to determine whether the regulations should be terminated, amended or retained in their current form. The review of the regulations will be guided by the principles listed in Executive Order Number Twenty-five (1998).
The purpose of these regulations is to protect public health and/or welfare with the least possible costs and intrusiveness to the citizens and businesses of the Commonwealth and to establish criteria and procedures for preparing and evaluating environmental impact assessments for oil or gas well drilling operations and related production and transportation activities proposed to occur in Tidewater Virginia to protect waters of the Chesapeake Bay from discharges of oil and gas resulting from operations/activities.
The department and the board are seeking public comment on the review of any issue relating to these regulations including whether (i) the regulations are effective in achieving their goals; (ii) the regulations are essential to protect the health, safety of welfare of citizens or for the economical performance of important governmental functions; (iii) there are less burdensome and less intrusive alternatives for achieving the purpose of the regulations; and (iv) the regulations are clearly written and easily understandable by the affected persons.
Comments on the above are welcome and will be accepted until March 19, 2001.
